Adapting strategies for global regulatory challenges
My approach to legal advising has evolved significantly over my fourteen-year career. Initially, I adopted a more normative approach. However, I have increasingly embraced a practical, easily understood, and readily implementable approach, focusing on preventative measures and improvement plans. It also felt amazing for a legal team to work in a tech company that provides internal AI tools to be more efficient in communicating the dispute strategy, trademark issues, policies and regulatory changes impact in different languages and different jurisdictions.
Having planning and effective networking is crucial. In a multinational corporation, numerous daily issues arise, and global company standards are often too general for a practical law enforcement reference in Indonesia. Many problems will fall under the blind spots. Therefore, proactive anticipation of local regulatory compliance developments is essential. Effective networking provides valuable insights into the upcoming regulatory frameworks, and discussion of best practices in important topics such as cyber security, data protection, ESG initiatives, International Arbitration, and internal investigation strategies. This knowledge, and the ability to foresee future trends, enhances the reliability and effectiveness of our legal advice.
Key Qualities for Effective Legal Advisors and Compliance Culture
Be approachable, be flexible, and learn to listen more. Information could come from many directions. People usually come just to tell us a story, then a couple of months later it could be a hostile situation. A simple act like addressing the right questions to the problem and agreeing on a small action plan could be the best way to mitigate the issues. Management values proactive communication and avoids surprises. Therefore, consistently keeping Management informed of potential issues is the key. A highly effective legal advisor understands Management's perspective, probing questions contextually and being able to engage strategically when issues arise as well as actively contributing to problem-solving. These qualities are essential for delivering our value as trusted and reliable legal advisors in a company.
Continuous learning, adaptability to new tech and strong networking are key for legal professionals. Cultivating strong communication and problem-solving skills helps navigate complex challenges and fosters a culture of compliance within the organization.
The Legal Team is leading an annual compliance program encompassing risk improvement, risk assessment, and risk prevention. Over the past two years, the program has incorporated data analysis, requiring a more data-driven approach in addition to direct engagement to employees. Nonetheless, I found that the most impactful activities to foster a culture of compliance should start with and be initiated by Management. Compliance culture in a company is a top-down concept. Therefore, obtaining continuous support from Management through numerous annual campaigns and training sessions for all employees is a must.
Technology Integration and Career Advice for Legal Teams
We utilize AI legal research databases, compliance management systems, and legal management systems (consisting of contract management, trademark review, advice, corporate secretarial records, and authorization). These tools help to streamline the processes, allow us to review the consolidated version of regulation changes to deliver reliable advice and facilitate more efficient communication and collaboration across teams and regions.
For peers and budding professionals, I would emphasize the importance of continuous learning, adaptability to the new tech especially AI tools and strong networking skills. The legal landscape is constantly evolving, so staying updated on new regulations and best practices is crucial. Building a strong network of contacts within and outside the industry provides invaluable support and insights. Furthermore, developing strong analytical and problem-solving skills is essential for navigating complex legal challenges. Finally, cultivating strong communication skills is vital for effectively conveying legal advice to the Management & business team. It also helps us foster a culture of compliance.
